These Terms of Service ("Terms") govern your use of EasyQueue, a queue management platform operated by a sole trader in the United Kingdom ("the Operator", "we", "us", or "our"). By accessing or using EasyQueue ("the Service"), you agree to be bound by these Terms.

Please read these Terms carefully before using the Service. If you do not agree to these Terms, you may not use the Service. We may update these Terms from time to time, and continued use of the Service constitutes acceptance of any revised Terms.

Definitions

  • "Service" refers to the EasyQueue platform, including the website, web application, mobile interfaces, APIs, and all associated features and functionality.
  • "User" or "you" refers to any individual or business entity that registers for, accesses, or uses the Service.

Use of Service

Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using EasyQueue, you represent and warrant that you meet these requirements.

Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for:

  • Maintaining the security and confidentiality of your account credentials.

Payment & Subscriptions

Pricing & Billing

EasyQueue offers monthly subscription tiers with different features and usage limits. Pricing is displayed on our website and is subject to change with reasonable notice. By subscribing, you agree to pay:

  • The monthly subscription fee for your chosen tier.
  • Any applicable taxes, VAT, or additional charges.
  • Fees for any usage beyond your plan limits, if applicable.

Payment Method

Subscription fees are billed monthly in advance. You must provide valid payment information and authorise us to charge your payment method on a recurring basis. If payment fails, we may suspend or terminate your access to the Service until payment is received.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing period. No refunds are provided for partial months or unused portions of your subscription, except where required by law. You will retain access to the Service until the end of your paid period.

Free Trials

We may offer free trial periods for new users. At the end of the trial, your account will be automatically charged unless you cancel before the trial ends. We reserve the right to determine trial eligibility and to modify or terminate trial offers at any time.

Liability & Disclaimers

Service Availability

We strive to provide a reliable and available service, but we do not guarantee that the Service will be uninterrupted, error-free, or completely secure. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

Limitation of Liability

To the fullest extent permitted by law, the Operator shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
  • Loss of profits, revenue, data, or business opportunities.
  • Errors, mistakes, or inaccuracies in the Service or Content.
  • Interruptions, delays, or failures in service availability.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months prior to the event giving rise to liability.

Indemnification

You agree to indemnify and hold the Operator harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your Content, your violation of these Terms, or your infringement of any third-party rights.

No Liability Exclusions

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

Termination

Termination by You

You may terminate your account at any time by cancelling your subscription and ceasing use of the Service.

Termination by Us

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if:

  • You breach these Terms or engage in prohibited conduct.
  • Your account is involved in fraudulent or illegal activity.
  • Your payment fails or becomes past due.
  • We are required to do so by law or regulatory authority.
  • We decide to discontinue the Service or specific features.

Effect of Termination

Upon termination, your right to use the Service immediately ceases. We may delete your account and Content, though we will make reasonable efforts to provide you with an opportunity to export your data. Provisions of these Terms that by their nature should survive termination (including payment obligations, liability limitations, and dispute resolution) shall continue to apply.

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have rights under the consumer protection laws of your country of residence, and nothing in these Terms affects those statutory rights.

Updates to Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or service features. When we make material changes, we will notify you by email or through a prominent notice on the Service at least 30 days before the changes take effect.

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Operator regarding the Service and supersede any prior agreements or understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms or transfer the Service to a third party without restriction.
